Your Privacy is very important to us and we want you to know how we respect and protect your privacy. The security of your personal information and sensitive system data is our priority. We protect your information by maintaining physical, electronic, and procedural safeguards that meet applicable law. We train our employees in the proper handling of personal information. When we use other companies to provide services for us, we require them to protect the confidentiality of personal information they receive.

If you disagree with our existing Privacy policies currently or as may be modified in the future, we will provide opt out options to protect you. Your secure information is never stored as plain text and is encrypted for your protection. You should be careful to maintain the secrecy of your passwords and/or account login information, and be responsible about protecting your personal information and identity whenever you are online.

We do not sell your personal information to third parties for any reason. We do not disclose your information to unaffiliated third parties, or to our affiliates, who may want to offer you their own products and services unless you have requested or authorized us to do so. We will only share your information with third parties when it is necessary to perform a system functionality you, the client, initiate or have granted us authorization to perform.

We may share your information with third parties or affiliates with whom we have contracted to perform services on our behalf. All companies that act on our behalf are contractually obligated to keep the personal information we provide to them confidential, and to use the personal information we share only to provide the services we ask them to perform.

Our Services, including sites, may contain links to third party sites. Please be aware, however, that we are not responsible for and cannot control the privacy policies of these other sites or their practices. We encourage you to read the privacy policies for these other sites, as they may differ from ours. This Privacy Policy applies solely to personal information collected by us.

ApparelMagic may access or disclose information about you in order to: (a) comply with the law or respond to lawful requests or legal process; (b) protect the rights or property of ApparelMagic or our clients, including the enforcement of our agreements or policies governing your use of the services; or (c) act on a good faith belief that such access or disclosure is necessary to protect the personal safety of ApparelMagic employees, clients or the public.

If ApparelMagic should merge with another company, or purchase another business, or sell or reorganize part of its business, it may be required to disclose your personal information to prospective or actual purchasers and other parties. It is our practice to obtain appropriate protections for information disclosed but we cannot, however, guarantee that our Privacy Policy will remain unchanged in this event.

Except as described in this statement, information and data you provide will not be transferred to third parties without your consent. 

Email Privacy

Why did you receive a mailing from us?
Our email marketing is compliant with CAN-SPAM laws in the USA. If you received a mailing from us, our records indicate that (a) you have expressly shared this address for the purpose of receiving information in the future (“opt-in”), or (b) you have registered or purchased or otherwise have an existing relationship with one of our marketing partners. We respect your time and attention by controlling the frequency of our mailings.

If you believe you have received unwanted, unsolicited email sent via this system or purporting to be sent via this system, or have any questions about our policies, please forward a copy of that email with your comments to sales@apparelmagic.com for review.

How can you stop receiving email from us?
Most marketing emails we send contain an easy, automated way for you to cease receiving email from us, or to change your expressed interests. If you wish to do this, simply follow the links at the bottom of the email.  Or, contact us at sales@apparelmagic.com.

How we protect your privacy:
We use appropriate security measures to protect against the loss, misuse and alteration of data used by our system.

Sharing and Usage
We will never share, sell, or rent individual personal information with anyone for their promotional use without your advance permission or unless ordered by a court of law.  Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you emails based on your request for information.

Use of Web Beacons
When we send you emails, we may include a web beacon to allow us to determine the number of people who open our emails. Web beacons collect only limited information, such as a cookie identifier, time and date of a page being viewed, and a description of the page on which the Web Beacon resides (the URL). Web Beacons can be refused when delivered via email. If you do not wish to receive Web Beacons via email, you will need to disable HTML images or refuse HTML (select Text only) emails via your email software.

Data Processing

NOTICE TO EUROPEAN UNION AND UNITED KINGDOM RESIDENTS:
Personal data is required to enter into contract with ApparelMagic. We collect personal data for the purpose of fraud prevention, communicating with leads and clients, user account maintenance, support, accounting, and other purposes. Processing this data is necessary for the performance of ApparelMagic and the administration of your account. All client personal and payment data is retained for a minimum of 2 years in order to keep accurate and lawful records. In the event that an EU/UK resident ends their ApparelMagic subscription, all of their in-system data will be retained for a minimum of 90 days, then securely deleted, unless otherwise requested.

Residents of the EU/UK may request a copy of their personal data collected by ApparelMagic and our processors for data rectification. Residents of the EU/UK may have their personal data erased upon request after these records are no longer used by ApparelMagic. Residents of the EU/UK have the right to withdraw consent from targeted marketing emails at any time by contacting sales@apparelmagic.com or clicking “Manage Preferences” or “Unsubscribe” at the bottom of all email messages. Residents of the EU/UK have the right to lodge a complaint with a supervisory authority. You may contact the data protection officer at sales@apparelmagic.com.

From time to time, we may change this policy. If you disagree with our existing Privacy policies currently or as may be modified in the future, we will provide opt out options to protect you. The effective date of this policy indicates the last time this policy was revised or materially changed.  Checking the effective date allows you to determine whether there have been changes since the last time you reviewed the policy.

Nature of the Processing
The manner in which personal data is handled might encompass activities such as: gathering, documenting, arranging, systematizing, preserving, modifying, fetching, reviewing, employing, sharing, distributing, granting access, merging, limiting, deleting, or destruction. 

Purpose(s) of the Processing
ApparelMagic processes personal data in its role as a processor (or, in instances where the client acts as a processor, as a sub-processor). This is done to offer, safeguard, back, facilitate, improve, and sustain the services in alignment with this Privacy Policy. 

Should the client choose to avail, or engage with specific supplementary services or functionalities, ApparelMagic may upload, replicate, and/or transmit client personal data to aid these selections. If the client decides to link the services to third-party offerings or services, ApparelMagic will harness the client’s personal data to establish this linkage. When ApparelMagic acquires personal data due to this linkage, it will handle the personal data consistent with this Privacy Policy and Terms of Service agreed upon at client signup. 

Furthermore, ApparelMagic might process certain personal data outlined in this Privacy Policy and Terms of Service to guide the enhancement of its offerings and conduct in-house investigations.

ApparelMagic uses the following sub-processors: Amazon Web Services, Anthropic, Chargify, Google, HubSpot, Microsoft, Monday.com, OpenAI, PartnerPage, PlanetScale, Slack, Stripe, Superbase, Twilio, Vercel, Zendesk.

Cookies
When you visit our website, cookies and similar technologies may be used by ApparelMagic to associate these activities with personal information we have about you, including your email address. ApparelMagic may then send communications to these email addresses. You may opt out any time by contacting sales@apparelmagic.com or clicking “Manage Preferences” or “Unsubscribe” where available. 

Data Privacy for Connected Third-Party Services

ApparelMagic integrates with various third-party services (Google, Microsoft, Shopify, etc.) to provide enhanced system functionality to our users. In the course of providing its services, ApparelMagic may access certain user data from these third parties. This data may include, but is not limited to, personal information such as names, email addresses, account information, and other information necessary to provide the functionality desired in the ApparelMagic system. ApparelMagic only accesses and uses connected third-party user data to connect your ApparelMagic system with your third party account, or to act on your behalf in the capacity that you have authorized as a result of this connection. We do not use this data for any purposes beyond improving our platform or delivering the services requested by you, the client. We do not transfer third-party user data to any external parties, except where required to facilitate the functionality of the application, improve user experience, or as required by law. Additionally, all third-party data is handled in strict compliance with applicable privacy laws and the privacy policies of the respective service providers.

Vendor Specific Data Access
Google: We access and store your account’s email address and your name. This information is used to identify your account and is not shared or transferred to any third parties.
Microsoft: We access and store your account’s email address and display name. This information is used to identify your account and is not shared or transferred to any third parties.

Retention and Deletion of Third-Party Data
In the event a client de-authorizes a connection between ApparelMagic and any third-party service, all personal user data stored as a result of that connection is immediately deleted from our systems. Additionally, if a client cancels their ApparelMagic subscription, all related user data, including data from third-party services, will be retained for a minimum of 90 days, then securely deleted, unless otherwise requested. Clients can also request the deletion of any third-party data at any time by contacting sales@apparelmagic.com.
